The Manner and Mode in which U.S. Senators are elected (Summary)- 


The winner of the most state senate districts throughout the state is declared the winner. A state senate district is won by the candidate who receives the most popular votes in that area. 

If there is a tie in the number of state senate districts won by two or more candidates, then the tying candidate who received the highest number of wards/districts in the entire state is declared the winner. 

In the unlikely event there is a tie in the number of wards/districts won by two or more candidates, then the candidates who tied are subject to a vote by the state senate. A quorum of 2/3rds must be present. The recipient of the most votes from members of the state senate is declared the winner. If there is a tie in the number of state senate votes received by two or more candidates, then the vice-governor casts the tie-breaking vote. 

No majority of state senate districts to be won, of wards/districts to be won, or of state senators' votes to be obtained by a senatorial candidate are needed because this federal senatorial position is legislative and not administrative. Any position closer to the People requires less of a mandate than an executive position requires. The people who make law have to be more directly connected to the People. The people who execute and administer the law have to be less directly connected to the People. 

Due to the fact the change of American governance after the end of the Civil War gave federal government the pre-eminent governmental authority, an elected body of lawmakers will never be permitted to select federal lawmakers. In general it is never prudent for an elected body of lawmakers to select members of another elected body of lawmakers. However, this would be a better alternative that allowing a direct popular vote for U.S. Senator. After all the federal senatorial position is based on a area based democratic model and its position needs to be less directly chosen by the electorate. However this measure would erode federal government sovereignty and therefore would be banned. 





Cliff Notes Version: A candidate for this upper federal house seat has to win the popular vote in a state senate district to win it. The candidate who wins the most state senate districts wins the election.

If there is a tie amongst the candidates who won the most state senate districts throughout the state, then the candidate who wins the highest number of wards/districts throughout the state wins the election. If a tie still exists, then the candidate who receives the most state senate votes becomes the U.S. Senator. The vice-governor casts, if necessary, the tie-breaking vote. 

No majority is needed with any voting scheme since the federal senatorial position is legislative and not executive.
