Representative Democratic Model- Selectable Offices Part Thirty-Seven (Session One)- Role Of The Federal Courts (U.S. District Courts)
People need to understand how the federal courts should work. Those courts are not the place for state court cases to be retried. Instead, it is where the claimant asserts that his/her rights under federal law (U.S. Constitutional and statutory) have been violated. The United States Code should comprise the vast majority of federal statutory law.
The claimant, when filing a case in an U.S. District Court, should not be required to overturn a verdict from the state court. Instead, he/she is filing a fresh claim in that federal court, alleging that his/her rights, as recognized by federal law(U.S. Constitutional and statutory) have been violated.
Cliff Notes Version: Federal courts do not retry state court cases. Rather, it is where a claimant asserts that his/her rights under federal law (U.S. Constitutional and statutory) have been violated. A fresh claim would be filed in these courts.
