The Filling Of Vacancies In The Federal Executive Heads Of Law Enforcement- U.S. Attorney General
If a Federal Attorney General (AG) cannot complete that term for any reason (removal, retirement, resignation, or death), then the Federal Assistant AG who that Federal AG earlier appointed becomes the Substitute Federal AG till the occurrence of the next legislative session. If the term of the vacated Federal AG expires at the end of that legislative session, the VPOTUS nominates and the U.S. House of Representatives confirms another individual for Federal AG . If there is a tie in the confirmation process, the POTUS can if willing cast a vote that would lead to the confirmation of a nominee.
If the term of the vacated Federal AG has not expired when the next U.S. House of Representatives' session takes place, the VPOTUS unilaterally selects the Acting Federal AG who will serve till the end of that term. The Substitute Federal AG is not eligible to serve as Acting Federal AG.
The Acting Federal AG should be subject to nomination by VPOTUS and then by confirmation by the U.S. House of Representatives if he/she desires to become the Federal AG after completion of the term that the vacated AG was scheduled to serve. Once nominated and then confirmed, the Acting U.S. AG becomes the U.S. AG for the entire next new term.
The President Of The United States or the federal legislatures should not get involved in the selection of an Acting U.S. AG. It would demonstrate direct democratic mode as involvement by too many government bodies means too much political interference.
In addition, the POTUS and members of the federal legislatures have a much more active role in government than the VPOTUS and therefore are more likely to possibly commit acts that would warrant investigation by the Federal AG Office than the VPOTUS. Therefore neither the POTUS nor the federal legislatures should have involvement in the selection of an Acting Federal AG or in the nomination of a candidate for the Federal AG position. If the POTUS and federal legislatures would have such involvement, that would strongly indicate Imperial Democratic Mode.
The choosing of any acting officeholder has to be more non-political than the choosing of an officeholder. An U.S. AG, in his/her attempts to serve the first term, should have to be both nominated and confirmed. However an individual initially serving as Acting U.S. AG only needs to be selected by the VPOTUS to serve the remaining term of the vacated U.S. AG.
A Substitute AG is barred from serving as both the Acting and as the Actual Federal AG. Otherwise the lack of this ban would precipitate Democratic Imperialism due to the fact centralization of power would result. An individual serving in multiple roles is considered Imperial Democratic Mode.
Allowing the Acting U.S. AG to serve longer than the remaining term without nomination and confirmation is also demonstrating Imperial Democratic Mode.
Cliff Notes Version: Upon the vacating of the Federal AG, the eligible individual who that Federal AG earlier appointed as the Assistant Federal AG, serves as the substitute for Federal AG, till the end of the next legislative session. If the term of that vacated judge expires at that session the Vice-President nominates another individual to serve as Federal AG and then the U.S. House Of Representatives, via majority vote, confirms that nominee as Federal AG. If there is a tie in the confirmation process, the POTUS can if willing cast a vote that would lead to the confirmation of a nominee.
If the term of that vacated judge does not expire when the next legislative session takes place, only the VPOTUS should select the Acting Federal AG. At the time of nomination and confirmation, the Acting Federal AG can become the Federal AG after completing the term of the vacated Federal AG.
