The Selection Of The Governor Pro Tempore of the State Senate- Part Three
Non-members can apply to the State Senate if they are interested in those positions as Governor Pro Tempore provided that candidate is not a participant in any branch of government. He/she also have to meet other Constitutional Requirements.
Any candidate worthy of a vote by the State House of Delegates/Assemblypeople has to first receive at least 25% of Yay votes in its roll-call. The vote-worthy eligible candidates then contest for each office.
The candidate who receives the highest number of votes cast by the members of the State House of Delegates/Assemblypeople either would become or would remain this officer of the State Senate. If there is a tie, then the State Speaker Of The House Of Delegates/Assemblypeople would cast the tie-breaking vote for the winning candidate.
This State Senate Officer obviously would not have the authority to cast votes on legislation. This is important so this officer is not compromised in his/her responsibilities because he/she will not have a direct stake in the legislation.
This State Senate Officer is chosen by the State House of Delegates/Assemblypeople members only when the President Of The State Senate (Vice-Governor) has vacated his/her office. The Governor Pro Tempore of the State Senate then becomes the Acting Vice-Governor (President of the State Senate). The new Governor Pro Tempore is selected by the same established process.
In case this newly selected Governor Pro Tempore has to later serve as Acting Governor, then the Assistant Speaker Of The House of Delegates/Assemblypeople acts as Vice-Governor. If the Assistant House Speaker is unwilling to start his/her term, the State House Of Delegates/Assemblypeople commences its process of choosing a qualified individual to start that term as Acting Vice-Governor.
The Assistant Speaker Of The House of Delegates/Assemblypeople is nominated by the Speaker Of The House of Delegates/Assemblypeople and then confirmed by the majority of members of The House Of Delegates/Assemblypeople, provided quorum limits are met.
