Catastrophes In Gulf Due To " Attorney Hactivism"-By Harsha Sankar

Dear Citizen, October 2005

Environmental lawsuits led to much of the horrendous flooding in New Orleans. Yet the media buries this fact. In the late 1970’s the Army Corps of Engineers proposed building fortifications at two strategic locations that would have withstood the fury of a Category 5 hurricane. An article in a New Orleans paper published three months Katrina stated those plans were abandoned after environmental advocates successfully sued to stop the projects as too damaging to the wetlands and the lake’s ecosystem.”

Needless to say, the destruction of New Orleans is testament to attorney “hactivism”. Too many laws are being decided by the courts, such the recent dastardly ruling on eminent domain by the despotic U.S. Supreme Court. It allows local governments to seize land from one private property owner and then transfer it to another private property owner (e,g. land developers).

One does not have to be a prophet to see that this dictatorial judicial fiat and decree will a major role in the months to come, especially in Mississippi, Alabama, Texas, & Louisiana.

The storm of lawsuits over Katrina and Rita is building more momentum than the storms themselves. Leading the way is Richard Scruggs, who helped sue the tobacco companies for a settlement of 368 billion dollars with federal government. The greater irony is while attorneys received in excess of one hundred thousand dollars per hour, smokers themselves received not one red cent.

In many cases, private insurance carriers have clauses in their policies that do not cover “flooding due to storm surges.” Besides, the taxpayer-funded federal government already provides a hefty $250,000.00 coverage to those in risk-prone areas who purchase it. However, to Scruggs ,fellow charlatan attorneys and their thousands of irresponsible clients, the bare facts and common sense do not matter. When a special elite are used to receiving anything they desire from institutions they either monopolize and control, they simply are not going to stop now.

Bankruptcy is going to be a major problem for millions. As many evacuees will remain destitute, attorneys will land hefty deals as they have with Delta Airlines, Northwest, US Airways, and United. They are definitely flying the friendly skies. While lawyers, along with investment bankers and other “consultants” will walk away with hundreds of millions of dollars in fees, shareholders will receive nothing. As so many employees have lost their jobs and savings, Delta’s bankruptcy lawyers are charging up to $785.00 an hour(much of that is either for their inefficient, inept time or for their paralegals' and secretaries' time).

The preceding abuses are not indicative of something that is voluntarily needed. This is simply conspiratorial imperialism by government's three branches. These horrendous activities exist because of co-operation from other sectors, including many in the grassroots. No one,not even the vast majority, has the right to undermine the republic that protects all people’s basic rights by firm rule of representative and objectively legitimate written law for all people at all times in all places.

America’s government is not supposed to be an unbridled democracy in which two wolves and a lamb decide what they are going to have for dinner.

We are a Constitutional Republic that is preserved by democracy. That is why America cannot have counsel in the judiciary, “officers of the courts” also as officers in the legislative and executive branches. It will erode checks and balances and submerge America into its dark ages.

Ultimately the American People will have to decide this issue for themselves and then act accordingly. While tyranny can be seductive and appealing, freedom is not free. People will
eventually determine which road will be traveled.

Very Truly Yours,
