Representative Democratic Model- Selectable Offices Part Seven


The State Chief Prosecutor's Office and the State Police are bifurcated into two separate and distinct departments. The State Police should provide public safety. The State Police should also investigate any possible crimes and indict if necessary. If an indictment is issued, the State Chief Prosecutor's Office takes over and if necessary tries to obtain an conviction. This separation is necessary to comply with the ideals of "Divided Governance".

The Governor should no longer nominate the head of the State Chief Prosecutor's Office because that would symbolize Imperial Democratic Mode. At the same time, the head of the State Chief Prosecutor's Office should no longer stand election by the electorate because that would symbolize direct democratic mode. If a Governor is currently suspected of committing a crime, it would be a conflict of interest for that Governor to be pursued by the State Chief Prosecutor's Office if the Governor nominated the head of that prosecutorial law enforcement agency.

Therefore the Vice-Governor should do the nomination and then the state legislative lower house (House Of Delegates/Assemblypeople) should do the confirmation by majority vote of the head of the State Chief Prosecutor's Office. The Governor should still do the nomination and then the state legislative upper house should still do the confirmation by majority vote of the head of the Chief of State Police.

The Governor should not nominate the head of the State Chief Prosecutor's Office because that would be Imperial Democratic Mode. The head of the State Chief Prosecutor's Office should not stand election as well because that would be direct democratic mode. If the Governor is suspected of a criminal act, it would be a conflict of interest to be pursued by the State Chief Prosecutor's Office if the Governor nominated its head.
