The Filling Of Vacancies In The State Executive Heads Of Law Enforcement- Chief Of The State Police

If a State Police Chief cannot complete that term for any reason (removal, retirement, resignation, or death), then the State Deputy-Police Chief who the vacated State Police Chief earlier appointed becomes the Substitute State Police Chief till the end of the next legislative session.
At that legislative session and if the term of the vacated State Police Chief has not expired, the State Governor appoints a new individual to act as State Police Chief until the term of the last full-time State Police Chief expires. After that term expires, an Acting State Police Chief is subject to Gubernatorial nomination and State Senate confirmation if he/she desires to become State Police Chief for the entire next new term.
The state legislature should not get involved in the selection of an Acting State Police Chief. It would demonstrate direct democratic mode as involvement by too many government bodies means too much political interference. In addition, since the state legislature is closer to the People than a state law enforcement department head and a governor, their participation in this selection would be unwarranted as the choosing of any acting officeholder has to be more non-political than the choosing of an officeholder.
The lower house of the state legislature should not get involved in the confirmation of any individual as State Police Chief for the reasons listed in the foregoing paragraph. The State House of Assemblymen/Delegates is closer to the People than the State Senate and its involvement would be too politically-oriented.
The prevention of Imperial Democratic Mode is why all those who acted as State Police Chief have to be nominated by the state head executive and confirmed the upper house of the state legislative body in order to become the actual State Police Chief. That is also why the Substitute State Police Chief, who was not chosen by an elected officeholder, should be prohibited from serving as Acting and Actual State Police Chief.

Cliff Notes Version: If State Police Chief vacates, the State Deputy-Police Chief who the vacated State Police Chief earlier appointed serves as Substitute State Police Chief till the end of the next legislative session. If the term of the vacated State Police Chief expires by the end of the next legislative session, the normal nomination and confirmation processes are conducted. If the term of the vacated State Police Chief expires after the end of the next legislative session, the State Governor unilaterally selects the Acting State Police Chief to serve until the expiration of the term of last full-time State Police Chief.
The Acting State Police Chief is then subject to nomination by the Governor and to confirmation by the State Senate after he/she completes serving the term of the vacated State Police Chief. If nominated and confirmed, the Acting State Police Chief becomes the State Police Chief for the entire next new term.
State legislature should not get involved in selecting the Acting State Police Chief. That would demonstrate direct democratic involvement. Moreover an Acting State Police Chief has to be nominated and confirmed to become the Actual State Police Chief. Also no substitute serving in this capacity should become either an Acting or Actual State Police Chief. That would demonstrate Imperial Democratic Mode.
